Is it permissible for the wife to stipulate to the husband that she wants to live alone after she used to live with his mother and father?
To stipulate or to request? To request. To stipulate this at the time of the contract. To request is better. And does he have to fulfill her request?
If the wife stipulated at the time of the contract that he should not make her live with his family, and he agreed to the condition, then he must fulfill it.
Because the Prophet ﷺ said: The conditions most deserving to be fulfilled are those by which you made intimacy lawful.
And if she does not feel this, and it is the custom of the people,
that he makes her live with his family, then she does not have the right to demand otherwise.
This is the custom. But if it is in a country where the custom is that the husband does not have his wife live with his family.
What is customary is like a condition.
For example, with us now, the custom is that the husband.
Moves, yes, he has his wife live with him and his family.
But there is a large group in society.
People know that if they get married, they will provide her with a separate home.
This is considered as if it were a condition. Now, if there is neither a condition nor a custom, and she lives with his family.
Does she have the right to ask for a separate place?
If it is possible to live with his family.
Because sometimes the family mistreats the wife.
They may mistreat her severely, especially if they see that the husband.
He loves her, so you find them pushing her away and making her dislike the place.
These people, no doubt, cause the wife to fall apart.
He says to his parents: Treat my wife well, and I am here.
If you do not treat her well, the poor woman remains in torment.
Her whole life, and then if he leaves with her and is alone with her.
He can still honor his parents, visit them in the morning and evening.
During Hajj, he stays with them for a day and a night, depending.
