The shaykh says: My father, before his death, wrote or instructed a gift.
To three people: me, my mother, and I became the third person.
He says: Is it permissible for us to divide the inheritance and ignore this gift, or should I act according to this gift? We say regarding the gift, if it was during his lifetime,
and not a will, and he gave it to everyone equally, then it is valid as a gift during his lifetime. But if it was a will, then there is no will for an heir.
A will for an heir, and that money returns to the original estate and is divided as inheritance. And Allah knows best.
