From Saudi Arabia, he says they put on ihram and passed the miqat without making talbiyah and without intention, and they only remembered after some distance. What is the ruling on.
Regarding the mawaqeet, we say that these mawaqeet were set for entering ihram from them, and for this reason the Prophet ﷺ says, as it is mentioned in the hadith of Abdullah ibn Abbas in the two Sahihs.
They are for them and for those who come to them from other than their people, for whoever intends hajj or umrah. Whoever intends hajj or umrah must enter ihram from them and it is not permissible for him to pass them.
These people are excused because they passed by out of forgetfulness, so we say they must return, and the sin is lifted from them but the obligation is not lifted, so the obligation that has now arisen for them is that they return in this matter.
And some people were made to return for this reason, because they passed the miqat, and a group of the sahaba were made to return as is mentioned about Abdullah ibn Umar and others.
So we say they should return, and the scholars differed on this issue regarding their passing the miqat.
And is a sacrifice required of them or not?
But we say that this issue is an exception, considering that they passed the miqat without being in ihram, meaning they did not enter ihram from the middle.
Between the miqat and the sanctuary, rather, they entered forgetfully and did not make the talbiyah. Based on this, we say they must return to the miqat, then enter ihram from there.
And if they entered ihram between the miqat and the sanctuary, is a sacrifice required of them since they made the intention from the wrong place or not? The majority of scholars say a sacrifice is required of them.
Some scholars held that a sacrifice is not required, and this is narrated from Ibrahim al-Nakha'i and others.
The more correct view is that a sacrifice is not required if they return, even if they made the intention along the way. The scholars who require a sacrifice say that since they made the intention and then returned.
It doesn't mean anything, it doesn't mean anything since it was forbidden for them by the intention, even if it was in the wrong place. The most apparent view is that nothing is required of them, nothing is required of them except seeking forgiveness and repenting.
Because they made the intention in the wrong place knowingly, but as for their returning from that,
it is wiped out by what relates to passing over, just by passing over. As for what was mentioned, that nothing of the prohibitions of ihram occurred from him.
In this we say, this also shows that they were not intending it, and they are excused by Allah the Mighty and Majestic, and nothing is required of them. Allah knows best.
