You are asking about the basmala with sura at-Tawba, what is the ruling on it?
The majority of scholars, and this is the view of most of the sahaba, may Allah be pleased with them, hold that the basmala is not placed between sura al-Anfal and sura Bara'a.
The reason for this is that the mushaf of Uthman was compiled in this way, and people followed him after that. This is mentioned by at-Tirmidhi in a narration from Abdullah ibn Abbas, who said to Uthman ibn Affan,
may Allah be pleased with him, Why did you join al-Anfal, which is from the Mathani, and Bara'a, which is from the Mi'in, and not place between them 'In the name of Allah, the Most Merciful, the Most Compassionate'?
He said, The Quran used to be revealed to the Messenger of Allah ﷺ.
And he used to say: Place such-and-such verse in the sura that contains such-and-such, and we would place it. And sura Bara'a was among the first to be revealed.
And soera al-Anfal was among the first to be revealed, and Bara'a was among the last to be revealed, and the Prophet, peace be upon him, died without clarifying, so we attached it to it because it is most similar to it.
Meaning, their topics are similar in soera al-Anfal and soera Bara'a, because they both deal with matters of battle, spoils, and other issues.
So it was attached to it, and the Prophet, peace be upon him, did not clarify the separation between them, so people continued this practice, and so it continued.
This is the practice of the people, and it is the opinion of most scholars, and for this reason we say that nothing is placed between the two soeras.
In the name of Allah, the Most Merciful, the Most Compassionate, and this is the mushaf of Uthman that spread throughout the world.
And people continued this in recitation and teaching, and the reciters after him also continued this interpretation, and Allah knows best.
